Client agrees to indemnify and hold GAS ICElinks, its affiliates and their respective
employees, consultants and other agents harmless from and against any losses,
costs, damages or expense including reasonable attorneys' fees resulting from
claims or actions arising out of or in connection with Client's participation
in the GAS ICElinks services, third party claims for infringement of copyright
or other intellectual property rights and violation of rights of privacy and
publicity. You agree that you are solely responsible for defending any claim,
and for payment of damages or losses resulting from the foregoing to both a
third party and to GAS ICElinks limitation of liability and warranty disclaimer
the GAS ICElinks web site, is available on an "as is" basis. GAS ICElinks
makes no warranty of any kind, whether expressed or implied, including any implied
warranty of merchantability or fitness of any service provided by GAS for a
particular purpose including, without limitation, the evaluations, the exchange,
the projects, the contents of any web sites or pages, any technical malfunction,
computer error, loss of data, delay in operation, computer viruses, communication
line failure, destruction or unauthorized use or access to any web sites or
records, or other injury damage or disruption to client. Notwithstanding the
foregoing, should GAS ICElinks be liable for any reason, client agrees that
in no event shall GAS' be responsibly for liability ever. In no event shall
GAS ICElinks be liable for any indirect, incidental, consequential, special
or exemplary damages arising out of or related to this agreement even if such
damages are foreseeable and whether or not GAS ICElinks has been advised of
the possibility thereof. GAS ICElinks will not be liable for, or considered
to be in breach of or in default, on account of any delay or failure to perform
as anticipated by the parties you further agree that you will not hold GAS ICElinks
responsible for any acts, errors, or omissions of any third party in connection
with the GAS ICElinks evaluation and exchange programs, ICElinks.org web site,
and/or sites linked to through the GAS.org web site. GAS ICElinks reserves the
right to reject any content at anytime. Payment information: you agree to use
a valid credit card to purchase the GAS ICElinks services, memberships are based
on yearly subscription, ICE links will automatically charge your account for
renewal of your yearly membership unless cancelled 48 hours prior to renewal
date, trial memberships will be billed for basic membership unless cancelled
before rebilling date (7 days after signing up). GAS ICElinks reserves the right
to increase fees or institute new fees at any time with reasonable notice posted
in advance on the GAS ICElinks web site. Chargebacks that are returned to GAS
ICElinks will have a $25.00 chargeback fee and a $25.00 processing fee added
to the account. All chargebacks are sent to collection and reported to credit
agencies in the account holders local country. GAS ICElinks may revise the Agreement
at any time by updating this page, changes of the agreement will be binding
to you.
PRIVACY POLICY
When you participate on the GAS site, we request certain information. GAS does not share any of your personally identifiable or transactional information with any person or entity. No other third party receives your personally identifiable information or other transactional data except for those with whom you make exchange transactions
